Welcome to DMVBlackSingles.com, a dating service for single adults in the New York tri-state area. DMVBlackSingles.com is owned and operated by DateWorld, L.L.C (collectively “Website,” “Site,” “Service,” or “DMVBlackSingles.com”). By using this website or any of the services that DMVBlackSingles.com provides, including but not limited to our website hosted events, you are agreeing that you have read, understood and agree to be bound by these Terms of Use (this "Agreement"), whether or not you register as a member the site. IF YOU OBJECT TO ANYTHING IN THIS AGREEMENT OR THE DMVBLACKSINGLES.COM PRIVACY POLICY, DO NOT USE THE WEBSITE OR ANY OF THE SERVICES. The Terms of Use may be changed by DMVBlackSingles.com at any time and will be effective immediately upon posting to the website. Your continued use of the Website or the Services constitutes acceptance of all changes to the Agreement.

MINORS MAY NOT BECOME MEMBERS. You must be at least eighteen (18) years of age and single or separated from your spouse to register for the Services. Membership in the Services is void where prohibited. By registering with the Services, you represent and warrant that you have the right, authority and capacity to enter into this Agreement and that you will abide by all of the terms and conditions of this Agreement.

You may become a Member and register for the Service for free. As a Member, you will have the ability to participate in all of the site’s features and services. However, in approximately 6-8 months from the date of launch, the features accompanying a free membership subscription may be restricted and you may need to purchase a paid membership in order to access additional features and services. We reserve the right, at any time, to change any fees or charges for using the Service. Any changes will be effective upon posting. When and if you register to become a Member, you agree to provide accurate, current and complete information about yourself as prompted by our “Join Now” form ("Registration Form"), and to maintain and update your information to keep it accurate, current and complete. You agree that we may rely on your Registration Data as accurate, current and complete. You acknowledge that if your Registration Data is untrue, inaccurate, not current or incomplete in any respect, we may terminate this Agreement and your use of the Service. While we do screen profiles for professionalism, nudity and other content bearing on the character of our site, we do not verify information in profiles, and we have no control over, do not guarantee, and are not responsible for the quality, truth, accuracy, legality or safety of our Members. You acknowledge that features, parameters or other services that we provide may change at any time.

This Agreement will remain in full force and effect while you use the Service and/or are a Member. We may terminate your membership by removing your profile, at any time, for any reason, with or without explanation. You may terminate your membership at any time via the Websites or by sending us an email notice of termination to support@DMVblacksingles.com.

The Website is for the personal use of individual Members only and may not be used in connection with any commercial endeavors. Organizations, companies, and/or businesses may not become Members and should not use the Service or the Website for any purpose. Illegal and/or unauthorized uses of the Website, including collecting usernames and/or email addresses of members by electronic or other means for the purpose of sending unsolicited email and unauthorized framing of or linking to the Website may be investigated, and appropriate legal action will be taken, including without limitation, civil, criminal, and injunctive redress. We reserve the right to review member messages containing content that are posted on the Website. Use of the Website is with the permission of DMVBlackSingles.com, which may be revoked at any time, for any reason, in DMVBlackSingles.com’s sole discretion.

Except for that information which is in the public domain or for which you have been given written permission, you may not copy, modify, publish, transmit, distribute, perform, display, or sell any such proprietary information, including but not limited to profiles, photographs, and any content posted on our web pages. By posting information, photographs or content on any Service, you automatically grant, and you represent and warrant that you have the right to grant, to us and other members, free of charge, an irrevocable, perpetual, non-exclusive, royalty-free, fully-paid, worldwide license to use, copy, perform, display, promote, publish and distribute such information, content and photographs and to prepare derivative works of, or incorporate into other works, such information and content, and to grant and authorize sub-licenses of the foregoing. You further understand that we reserve the right to crop your photos, remove content from your profile or otherwise alter your profile to comply with DMVBlackSingles.com Terms of Use.
You agree that we have no responsibility or liability for the deletion, corruption or failure to store any messages or other content maintained or transmitted by DMVBlackSingles.com.

You are responsible for maintaining the confidentiality of the username and password that you designate during the Registration process, and you are fully responsible for all activities that occur under your username and password. You agree to select a user password ("User Password") that is unique and entirely different from your user name ("User Name") when registering for the Services. You agree not to use for your User Password personal information such as portions of your address, phone number, username, or your name or any simple words that might be guessed (we recommend you use a combination of letters and numbers to make it unique). You agree that you will never divulge or share your User Name or User Password with any third person or entity for any reason. You agree not to allow anyone else to access or use your membership account or provide them with your login information to do so. If you do so, we cannot protect your personal information in your membership account against compromise or theft. You further agree to immediately notify DMVBlackSingles.com of any unauthorized use of your username or password or any other breach of security, and to ensure that you exit from your account at the end of each session. DMVBlackSingles.com will not be liable for any loss or damage arising from your failure to comply with this provision. You should use particular caution when accessing your account from a public or shared computer so that others are not able to view or record your password or other personal information. If you share your computer with others, you may wish to consider disabling your auto-sign in feature if you have linked your Window's Live ID to your DMVBlackSingles.com account.

You are solely responsible for all content that you upload, publish, or display (collectively, "post") on or through the Website or Services or that you transmit to or share with other members or third parties via the Services (collectively, "User Content"). The Services merely provide a passive conduit for the distribution of your User Content. We reserve the right to remove your User Content if we believe that it may create liability for us. You shall not portray a picture of any person other than yourself in your dating profile. The following is a partial list of Content that is illegal and prohibited on the Site:
- Harassing or advocating harassment of another person;
- Engaging in patently offensive to the online community, such as Content that promotes racism, bigotry, hatred or physical harm of any kind against any group or individual;
- Promoting information that you know is false, misleading or promotes illegal activities or conduct that is abusive, threatening, obscene, defamatory or libelous;
- Transmitting or assisting in the transmission of "junk mail", "chain letters," or unsolicited mass mailing or "spamming";
- Promoting an illegal or unauthorized copy of another person's copyrighted work, such as providing pirated computer programs or links to them, providing information to circumvent manufacture-installed copy-protect devices, or providing pirated images, audio or video, or links to pirated images, audio or video files; contains restricted or password only access pages, or hidden pages or images (those not linked to or from another accessible page);
- Providing material that exploits people under the age of 18 in a sexual or violent manner, or solicits personal information from anyone under the age of 18;
- Providing instructional information about illegal activities such as making or buying illegal weapons, violating someone's privacy, or providing or creating computer viruses;
- Solicits passwords or personal identifying information for commercial or unlawful purposes from other users; and
- Engages in commercial activities and/or sales without our prior written consent such as contests, sweepstakes, barter, advertising, and pyramid schemes.
- Impersonates any person or entity.
- Using any robot, spider, site search/retrieval application, or other manual or automatic device or process to retrieve, index, "data mine", or in any way reproduce or circumvent the navigational structure or presentation of the Service or its contents.
- Removing any copyright, trademark or other proprietary rights notices contained in the Service.
- Posting, emailing or otherwise transmitting any material that contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment.
- Forging headers or otherwise manipulating identifiers in order to disguise the origin of any information transmitted through the Service.
- Framing or mirroring any part of the Service or the Website, without DMVBlackSingles.com prior written authorization. You also shall not use meta tags or code or other devices containing any reference to DMVBlackSingles.com or the Service or the site in order to direct any person to any other web site for any purpose.
- Modifying, adapting, sublicensing, translating, selling, reverse engineering, deciphering, or otherwise disassembling any portion of the Service or the Website or any software used on or for the Service or cause others to do so.

Should you violate any of this paragraph's terms or any terms of this Agreement, we reserve the right to investigate, review User Content, and take appropriate action which we determine necessary in our sole discretion, including without limitation, removing the offending User Content and terminating the membership of such violators.

In addition, you agree to defend, indemnify, and hold Us and Our officers, directors, employees, agents and third parties harmless, for any losses, costs, liabilities or expenses relating to or arising out of Your use of the Service, including:
- Your breach of this Agreement;
- Any allegation that any materials that you submit to Us or transmit to the Service infringe or otherwise violate the copyright, trademark, trade secret or other intellectual property or other rights of any third party; and/or
- Your activities in connection with the Service. This indemnity shall be applicable without regard to the negligence of any party, including any indemnified person.

YOU UNDERSTAND THAT DMVBLACKSINGLES.COM DOES NOT IN ANY WAY SCREEN ITS MEMBERS, NOR DOES DMVBLACKSINGLES.COM INQUIRE INTO THE BACKGROUNDS OF ITS MEMBERS OR ATTEMPT TO VERIFY THE STATEMENTS OF ITS MEMBERS. DMVBLACKSINGLES.COM MAKES NO REPRESENTATIONS OR WARRANTIES AS TO THE CONDUCT OF MEMBERS OR THEIR COMPATIBILITY WITH ANY CURRENT OR FUTURE MEMBERS. IN NO EVENT SHALL DMVBLACKSINGLES.COM BE LIABLE FOR ANY DAMAGES WHATSOEVER, WHETHER DIRECT, INDIRECT, GENERAL, SPECIAL, COMPENSATORY, CONSEQUENTIAL, AND/OR INCIDENTAL, ARISING OUT OF OR RELATING TO THE CONDUCT OF YOU OR ANYONE ELSE IN CONNECTION WITH THE USE OF THE SERVICE, INCLUDING WITHOUT LIMITATION, BODILY INJURY, EMOTIONAL DISTRESS, AND/OR ANY OTHER DAMAGES RESULTING FROM COMMUNICATIONS OR MEETINGS WITH OTHER REGISTERED USERS OF THIS SERVICE OR PERSONS YOU MEET THROUGH THIS SERVICE. YOU AGREE TO TAKE REASONABLE PRECAUTIONS IN ALL INTERACTIONS WITH OTHER MEMBERS OF THE SERVICE, PARTICULARLY IF YOU DECIDE TO MEET OFFLINE OR IN PERSON. IN ADDITION, YOU AGREE TO REVIEW DMVBLACKSINGLES.COM DATING SAFETY TIPS PRIOR TO USING THE SERVICE. YOU UNDERSTAND THAT DMVBLACKSINGLES.COM MAKES NO GUARANTEES, EITHER EXPRESS OR IMPLIED, REGARDING YOUR ULTIMATE COMPATIBILITY WITH INDIVIDUALS YOU MEET THROUGH THE SERVICE.
If You have a dispute with one or more of our Members, you release us (and our officers, directors, agents, subsidiaries, joint ventures and employees) from any claims, demands and damages (actual and consequential) of every kind and nature, known and unknown, arising out of or in any way connected with such dispute.

Although each member must agree to our terms and conditions, we cannot guarantee that each member is at least the required minimum age, nor do we accept responsibility or liability for any content, communication or other use or access of the Service by persons under the age of 18 in violation of this Agreement. Also, it is possible that other members or users (including unauthorized users, or "hackers") may post or transmit offensive or obscene materials through the Service and that You may be involuntarily exposed to such offensive or obscene materials. It also is possible for others to obtain personal information about you due to your use of the Service. Those others may use your information for purposes other than what you intended. We are not responsible for the use of any personal information that you disclose on the Service. Please carefully select the type of information that You post on the Service or release to others. IN NO EVENT WILL DATEWORLD LLC BE LIABLE TO YOU OR TO ANY OTHER PERSON FOR ANY INCIDENTAL, CONSEQUENTIAL, OR INDIRECT DAMAGES (INCLUDING, BUT NOT LIMITED TO, DAMAGES FOR LOSS OF DATA, LOSS OF PROGRAMS, COST OF PROCUREMENT OF SUBSTITUTE SERVICES OR SERVICE INTERRUPTIONS) ARISING OUT OF THE USE OF OR INABILITY TO USE THE SERVICE, EVEN IF WE OR OUR AGENTS OR REPRESENTATIVES KNOW OR HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. NOTWITHSTANDING ANYTHING TO THE CONTRARY CONTAINED HEREIN, OUR LIABILITY TO YOU FOR ANY CAUSE WHATSOEVER, AND REGARDLESS OF THE FORM OF THE ACTION, WILL AT ALL TIMES BE LIMITED TO THE AMOUNT PAID, IF ANY, BY YOU TO US FOR THE SERVICE DURING THE TERM OF YOUR MEMBERSHIP. AS DISCUSSED ABOVE, WE DO NOT CONDUCT BACKGROUND CHECKS OR OTHERWISE SCREEN MEMBERS REGISTERING TO THE SERVICE IN ANY WAY. WE WILL NOT BE LIABLE FOR ANY DAMAGES, DIRECT, INDIRECT, INCIDENTAL AND/OR CONSEQUENTIAL, INCLUDING BY NOT LIMITED TO PHYSICAL DAMAGES, BODILY INJURY OR EMOTIONAL DISTRESS, ARISING OUT OF THE USE OF THIS SERVICE, INCLUDING, WITHOUT LIMITATION, DAMAGES ARISING OUT OF YOUR COMMUNICATIONS WITH AND/OR INTERACTIONS WITH ANY OTHER MEMBER OF THE SERVICE, OR ANY INDIVIDUAL YOU MEET VIA THE SERVICE.

This Agreement is governed by the laws of the State of New York without regard to its conflict of law provisions. You agree to personal jurisdiction by and exclusive venue in the state and federal courts of the State of New York with regard to any and all claims by you arising out of or related to the Website. This Agreement shall not be governed by the United Nations Convention on Contracts for the International Sale of Goods, the application of which is hereby expressly excluded.

Our failure to exercise or enforce any right or provision of this Agreement shall not constitute a waiver of such right or provision. If any provision of this Agreement is found by a court of competent jurisdiction to be void, invalid or unenforceable, the parties nevertheless agree that the court should endeavor to give effect to the parties' intentions as reflected in the provision. In such case, the other provisions of this Agreement shall remain in full force and effect.
